Oppose HB 51 – Decriminalization of Abortion

In 1969 laws were passed in New Mexico outlawing abortion in our State. The legislation has remained law even though the Supreme Court’s Roe v Wade decision in 1973 made abortion legal throughout the United States.
Should Roe v Wade be over turned or modified by the Supreme Court, the issue of abortion then reverts back the states. The 1969 law in New Mexico would then again be law. The Democratic party is fearful of that being the case. The party leadership, primarily Brian Egolf (D-Santa Fe) have made removing the law and its protections, top priority.
The bill has been pre-filed, fast-tracked, and scheduled for an initial hearing as soon as possible. The bill, HB 51 – Decriminalization of Abortion (Joanne Ferrary D. Las Cruces), is assigned to the House Consumer and Public Affairs Committee.
If HB 51 passes and Roe v Wade is struck down, no law will be in place and anyone could, in theory, perform abortions. Medical staff, doctors and nurses etc. could be forced to perform abortions against their conscience. And no legal basis for not allowing forced abortions would exist.
Because HB 51 is fast-tracked, a hearing on the bill may take place this Saturday, January 26, 2019 by the House Consumer and Public Affairs Committee. When the hearing on this bill is confirmed, you will be informed.
