HB 7 HOUSE FLOOR VOTE IMMINENT BY NEXT WEEK

QUICK UPDATE: NMAFL has received notice from our contacts in the NM legislature that HB 7, the radical abortion and transgender procedure mandate bill, will most likely be heard next week. Although it has appeared on the schedule every day this week, several sources indicate a vote by next week is imminent. Stay tuned for updates.

A note from our Executive Director, Elisa Martinez.: Friends — you may hear of numerous pro-life bills being introduced this session. However, it has always been our policy since spearheading historic pro-life legislation and historic public involvement to only introduce 2-3 pro-life bills per session when we do not have a pro-life majority. We believe our #1 weapon is YOU, the public. Too many emails, calls and hearings for bills that will ultimately die in committee dilutes our message and creates confusion when we must remain focused on killing BAD BILLS that could actually become law. For this reason, we will keep our focus this legislative session to 2-3 pro-life bills we helped strategically draft for alerts as our primary focus is to kill radical bills like HB 7 and any others that may still be introduced. TIME IS RUNNING OUT – TAKE ACTION HERE:

GREAT JOB! New Mexico Alliance for Life has now received OVER 8,000 petitions to Stop HB 7 from concerned citizens across the state to be submitted to 70 members of the NM House. KEEP UP THE PRESSURE!

WHAT HB 7 DOES:

  • HB 7 will force all New Mexico public institutions that receive public funding and employees, such as elementary school teachers to refer or provide any request for abortion and “gender-affirming” health care – despite the best interest of the child for an elective procedure: Section 3B.
  • HB 7 will penalize the public employer or body that “directly OR indirectly” “deny, restrict or interfere with a person’s ability to access or provide reproductive health care or gender-affirming health care” — despite the best interest of the child or individual: Section 3B, and amended section 5D.
  • HB 7 seeks to ban any effort by all lawmaking bodies at the local and state level from legislating against it, “a public body or agent of a public body shall not impose or continue in effect any law, ordinance, policy or regulation that violates or conflicts with the provisions set forth in this bill:” Section 3D.
  • HB 7 violates the constitutional rights of all New Mexicans for due process, freedom of speech, freedom of religion and equal protection. It penalizes New Mexico’s public bodies under threat of prosecution and civil penalties up to $5K for an agent exercising any of these constitutional rights. Section 5C.

If HB 7 passes the House Floor, it will then move to the NM Senate for committee hearings: most likely in the Senate Health & Public Affairs and Senate Judiciary committees before the Senate Floor. Action items below!

Rep Ryan Lane on HB 7: “A child will rely on trusted adults? That statement frankly terrifies me. I have children and that statement terrifies me. Again does this bill apply to an 8 year old. I’ve asked a straightforward question and am not getting an answer. This bill creates new statutory rights; I want to know what person it applies to. I just want to know does the bill apply to an 8 year old or not.”

In fact, the Democrat controlled New Mexico legislature removed any laws that require parental involvement for a child seeking an abortion — while New Mexico Alliance for Life draft legislation has attempted to address this very concern.

“This bill sends a chilling affect across every public body and every public employee across the state. Ideologically driven legislation like this has exact opposite affect to what the sponsors proclaim, as it is a mandate on behavior to refer or participate in abortions and transgender procedures for every public employee,” said Elisa Martinez founder and executive director of New Mexico Alliance for Life. “HB 7 redefines the meaning of discrimination in the most broadest and irresponsible terms to proclaim anyone who opposes cross-sex hormones or surgery or abortion is in violation of the act and thereby their employer is ripe for penalty.”

An amendment was offered by Representative Gail Chasey (D- Bernalillo) for penalties to apply only to a public body, rather than an individual public employee. The amendment passed on an 11-0 vote, but does not change any other radical aspect and mandates within the bill.

From New Mexico State Senator, Dr. Gregg Schmedes, the only practicing health care professional in the NM Legislature:

“As a parent and practicing physician, I am deeply concerned about HB 7 forcing teachers and public employees to facilitate elective procedures – despite the best interest of our children. There are negative impacts to the mental, physical and emotional health of any elective procedure and HB 7 completely ignores the actual science,” said State Senator, Dr. Gregg Schmedes, a practicing physician.
