SB 13, Reproductive and Gender-Affirming Protection Act, “Substitute” Bill Muzzles Pro-Life Speech, Communications. Senate Floor Vote Expected TODAY, 11 AM.
HB 7 Concurrence Vote Expected Tonight on House Floor
BREAKING: In a shocking turn of events, the pro-abortion lobby’s quest to destroy New Mexico before the end of the 60-day legislative session is not yet complete. Late Tuesday night, in the Senate Judiciary committee, testimony was delayed until 9:30 PM for SB 13, the Reproductive and Gender Affirming Protection Act a companion bill to HB 7. Pro-life citizens, including NMAFL’s Elisa Martinez, Jodi Hendricks of Family Action Movement and legal analyst from the ACLJ waited patiently for nearly 8 HOURS to testify on Zoom, but like the SB 13 hearing in the Senate Health committee, we were hastily dismissed as “not present” – in order to rush through the bill.
WHAT IS GOING ON WITH SB 13? A NEW VERSION CENSORS PRO-LIFE COMMUNICATIONS!
In a shady, dark of night move, the Senate Judiciary committee introduced and voted on a substitute version of the bill that not only applies severe penalties to interstate communications but goes directly after pro-life first amendment rights and first amendment rights in general. The new version, or “committee substitute” of SB 13, in section 6A reads:
“HEIGHTENED PROTECTION FOR ELECTRONICALLY TRANSMITTED INFORMATION
It shall be a violation of the Reproductive and Gender-Affirming Health Care Protection Act to request from a third party, or for a third party to transmit, information related to an individual’s or entity’s protected health care activity with the intent to: harass, humiliate or intimidate that individual or entity; or incite one to harass, humiliate or intimidate that individual or entity; cause an individual to suffer emotional distress…”
As NMAFL pointed out previously, SB 13 seeks to enshrine reproductive and gender affirming procedures as “protected health care,” in NM law. Section 6 asserts that any electronic communication related to an individual or entity’s “protected health care activity” that could be construed as an intent to harass, intimidate or even cause “emotional distress,” is a violation of the act an in section 8A and 8B could be prosecuted for up to $10,000 in fines.
The fine for pro-life speech or any speech that involves transmitting reproductive or gender affirming health care aspect of the bill, among others, is so radical that even pro-abortion Senator Joseph Cervantes voted against the egregious $10,000 fine for merely causing “emotional distress.”

This legislation seeks to increase funding for school based health clinics and expands access to abortion and gender affirming procedures on school grounds. This legislation also allows sexual activity related youth services to occur without parental consent. SB 397 opens access to radical medical procedures on students in schools without permission from consenting adults – including transgender procedures. SB 13 – The Reproductive and Gender Affirming Health Care Protection Act Hearing in Senate Judciary most likely tomorrow at 1:30 PM. SB 13 eliminates interstate regulation allowing out of state minors to travel to New Mexico to receive traumatic, irreversible abortions and radical gender affirming care.
