NM Supreme Court Rules Against God’s Babies: Issues Stay on Enforcement of City, County Ordinances Banning Abortions

BREAKING: New Mexico Supreme Court Issues Stay on Enforcement of City, County Ordinances Banning Abortions

Pending Court’s Review of Radical HB 7, Reproductive & Gender Affirming Act’s Effect

Santa Fe, NM — Friday the New Mexico Supreme Court issued a ruling temporarily prohibiting enforcement of county and city ordinances banning abortions until the court examines the effect of HB 7, the Reproductive and Gender Affirming Act. The court ordered plaintiff counties and cities with ordinances to submit “brief in chief” reviews of HB 7, in anticipation of the law taking effect on June 16, 2023.

“In predictable fashion, the Leftist judicial activists on the New Mexico Supreme Court have inserted themselves in the law-making process by issuing a stay on city and county ordinances banning certain abortions,” said Elisa Martinez, New Mexico Alliance for Life Executive Director. “Unfortunately, this is what the New Mexico Supreme Court has become, a back-up legislative arm of the Democrat Party of New Mexico, who is financially backed by the abortion lobby.”

Earlier this month, the New Mexico legislature passed a series of the nation’s most radical abortion, infanticide and transgender mandate bills, including HB 7, which would prohibit cities, counties and the legislature from enforcing or passing any measures that would conflict with abortion on demand for any reason. HB 7 also contains infanticide language, which mirrors that of legislation in California and Maryland.

The abortion-lobby backed, New Mexico Attorney General Raul Torrez requested the court’s intervention in January in a response to a handful of city and county ordinances banning abortion drugs by mail. Torrez called on the court to strike down the ordinances by falsely claiming the state Constitution guarantees a right to abortion.

The “brief in chief” reviews of HB 7 are to be submitted to the court by April 20, 2023 and the court’s response 20 days thereafter.
