Fox News reports that U.S. District Judge Mark Scarsi, the federal judge overseeing the Internal Revenue Service (“IRS”) tax evasion case against Hunter Biden, issued a sharp rebuke of President Joe Biden’s claim that his son was unfairly treated and stated that the pardon was not properly served to the court, as the court only received a link to a press release, not the actual order pardoning Hunter Biden.
Judge Scarsi accused President Biden in a scathing five-page order of “rewriting history” with the pardon and suggested that the breadth of the pardon granted to his son is unconstitutional, writing that:
“The Constitution provides the President with broad authority to grant reprieves and pardons for offenses against the United States, but nowhere does the Constitution give the President the authority to rewrite history.”

My brothers and sisters, as FGGAM reported HERE on Monday (12/2/2024), President Biden’s pardon of his son Hunter Biden is unprecedented, with some suggesting, as with U.S. District Judge Mark Scarsi, that the Hunter Biden’s pardon is unconstitutional.
The potential unconstitutionality, in part, results from concern that:
- The pardon has a 10 year period of applicability;
- The pardon’s scope includes all crimes, without any specificity;
- The pardon covers crimes not yet discovered (let alone investigated); and
- The pardon covers crimes currently under investigation but have not yet resulted in charges, convictions and/or sentencing.
It is also convenient for President Biden that the pardon covers the period in 2014 when Hunter Biden assumed the role of board member with the now-defunct Burisma Holdings, Ltd. in Ukraine, about which the U.S. Congress has been investigating both Hunter Biden’s and President Biden’s roles or influence involving allegations of money laundering and improper payments in the millions of dollars to the Biden family.
Unbelievably, and beyond the fact that President Biden was untruthful in the past when he declared he would trust the judgement of the courts and would not pardon his son, the Hunter Biden pardon may also protect President Biden himself from legal jeopardy, without actually taking the additional and unprecedented measure of pardoning himself. The Hunter Biden pardon makes it that much more difficult or impossible for investigators to pursue charges against the members of the Biden family because of the difficulty in obtaining probative, corroborated and allowed evidence of wrongdoing.
I will not attempt to prognosticate what is going to happen legally, as even so-called ‘brilliant legal minds’ and ‘legal experts’ always manage to disagree with each other, and politics does tend to seep into the thinking of most human beings, even if subconsciously.
However, there are a few things which seem clear. Politics will always be messy, and in some ways, this is not only understandable, but is a net positive for the country given the old adage that says ‘absolute power corrupts absolutely.’
The Biden administration’s repeated statements (including televised comments) assailing 50% of the country as ‘threats to democracy’ and ‘evil’ because of the godly position that babies should not suffer murder (abortion) and because children should not be mutilated sexually while suffering mentally or emotionally over gender confusion (with or without the approval of parents), have unleashed disunity across the nation.
The arguable but seemingly accurate view that the federal legal system has been politicized and legally speaking – ‘weaponized’ – against the Biden administration’s political opponents, is now a legitimate concern, given the unsuccessful double impeachments, and the large number of questionable federal and state court cases against President Trump, as well as the ongoing investigation, charges and resulting incarceration of ‘J6’ protesters – many of whom are still incarcerated to this day. And, let’s not forget the made-for-TV ‘J6 Select Committee’ hearings and the sudden end to the committee with all of the so-called ‘evidence’ intentionally destroyed with no apparent repercussions.
And on the other hand, given the results of the 2024 General Election, there are legitimate concerns that in the process of correcting the current imbalances, priorities and focus within the federal justice system, the GOP runs the risk of overreach and falling into a similar trap.
So what does all this portend? Well, it seems to this writer that what the United States desperately needs is for men and women of God (read: followers of Jesus), as led by the Holy Spirit, to seek elected office and appointed governmental positions of influence to restore and walk in truth, integrity and godly love, speaking out against evil and seeking what is best for the greater good, our country and its people.
This is not a ‘violation’ of the argument of ‘separation of church and state,’ but it is the only way to assure the success of our civil government! Nearly all of America’s founders were men of the Christian faith. The First Amendment to the U.S. Constitution, beginning with “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof…”, assures that the government will not mandate an official ‘religion’ and that citizens may exercise their religious beliefs without governmental interference. In other words, it is intended to keep government out of citizens’ religious beliefs. It is not intended to keep men and women who hold godly faith from participating in government (or requiring them to park their Biblical beliefs outside the doors of congress or workplaces and pick them back up again on the way home).
The United States needs, more than ever, governmental employees who are not political activists, but those who will speak, legislate and administrate truthfully, with integrity and genuine love for the country and its citizens. In other words, we need leaders who hold a Biblical Worldview!
Let’s pray for our nation, its leaders and its future leaders, asking God to bring healing to our land!
